The Genesee County Prosecutor appeals by leave granted from a circuit court decision permitting defendant, John Solon Rodgers, to waive his right to a jury trial over the prosecutor’s objection. We reverse.

The charges against defendant stemmed from a fatal automobile accident on October 13, 1987. On April 11, 1988, defendant was arraigned on charges of second-degree murder 1 and leaving the scene of a serious personal injury accident. 2 On September 28, 1988, defendant sought to waive a jury trial.
