This is an action on the case for personal injury. The case was tried before a jury, who returned a verdict in favor of plaintiff for $4,000. No testimony was offered on behalf of the defendant. The defendant’s first contention is that no actionable negligence is alleged in the declaration, and that none was proved upon the trial, and that, therefore, the court should have directed a verdict for the defendant.
