Plaintiff filed a bill to restrain defendant from enforcing or attempting to enforce against it an ordinance to regulate tbe location and maintenance of gasoline filling stations and to grant licenses therefor. Defendant moved to -dismiss tbe bill of complaint because it did not state a cause of action, tbe ordinance was valid, tbe license fee provided therein not a tax, tbe ordinance within tbe power of tbe city, and a valid regulatory ordinance. Tbe trial court dismissed tbe bill of complaint, and plaintiff appeals.
