MEMORANDUM AND ORDER
SEYBERT, District Judge:
Pending before the Court is Defendants’ motion for summary judgment. For the reasons that follow, the Court GRANTS summary judgment for both Defendants.
BACKGROUND 1
Somewhere in the years 1996 or 1997, Plaintiff Mr. Michael Delehanty (“Mr. Delehanty”) purchased a 24-foot-fiber-glass-extension ladder manufactured by KLI from a local Home Depot. (Defs’ 56.1 Stmt. ¶ 3.) Several years after its purchase, on October 26, 2006, Mr. Delehanty was using the ladder to paint the rear of his home.
