Pending before the Court are plaintiff Commissions Import Export, S.A.’s (“Commisimpex”) motion for summary judgment and defendants the Republic of the Congo and Caisse Congolaise d’Amor-tissement’s (“CCA”) (collectively “Congo”) motion for substitution pursuant to Fed. R.Civ.P. 25(c). ECF Nos. 37, 54. The Court previously denied the summary judgment motion and dismissed this case. ECF No. 43.
