On April 16, 2008, this Court denied plaintiff New York State Restaurant Association’s motion for a declaratory judgment and a preliminary injunction against the enforcement of New York City Health Code Section 81.50 (“Regulation 81.50”). See N.Y. State Rest. Ass’n v. New York City Bd. of Health, No. 08 Civ. 1000, 2008 WL 1752455 (S.D.N.Y. Apr. 16, 2008) (opinion and order denying preliminary injunction).
