Appeal from a judgment of the County Court of Washington County (McKeighan, J.), rendered October 5, 2012, convicting defendant upon his plea of guilty of the crime of burglary in the third degree.

In satisfaction of a five-count indictment, defendant pleaded guilty to one count of burglary in the third degree and waived his right to appeal. Pursuant to the plea agreement, defendant was promised a sentence of 2 to 6 years in prison, with a recommendation of shock incarceration.
