Appellant was convicted of assault with intent to kill one Lewis Lee Baker with a pistol, in violation of See. 4408, R. S. 1939, Sec. 4014, Mo. Stat. Ann., p. 2817. The maximum punishment fixed by the statute is life imprisonment in the penitentiary. The duration of the punishment assessed by the jury was thirty years.
