Chase, J.:
John Kliff and his wife for several years maintained a restaurant principally for railroad employees at Hopewell Junction, in the county of Dutchess. They accumulated several hundred dollars in cash which they retained in their personal possession at the restaurant. Early Sunday morning, January 24, 1907, Mr. Kliff was struck upon his head with some instrument which crushed his skull, from the effects of which he died that day.
