There is evidence showing these facts: James W. Palmer, seventeen years ©f age, was run over and killed by one of the appellee’s trains while walking along its track not far from a highway crossing in the village of Leroy, His hearing was so defective that he could not hear the rumble of an approaching train if very far off, but he could hear the whistle of the locomotive.
