Cureton, Judge:

Wayne Gibson and Jack Durham, doing business as Kwik Chek, commenced this suit to enforce specific performance of an oral lease of a building owned by Jim Hrysikos. The circuit court consolidated this suit with an action brought by Collins Music in Magistrate’s Court to eject Gibson and Durham from the premises, claiming it was the lessee. The trial judge found Hrysikos had given an oral lease to Gibson and Durham and ordered him to execute a written lease in accordance with the agreed terms shown at trial.
