Ollie May Tutor, joined by her husband, brought this suit against the city of’ Amarillo, to recover damages for person al injuries sustained by her. The trial, court sustained a general demurrer to plaintiff’s petition, and she appeals.

Plaintiff alleged that the city had, at the time of the injury, the exclusive control over the streets at a certain point therein at the intersection of Third and Polk streets; that at such time it was engaged in the operation for hire of a street car line in the city, which was constructed and operated on said streets just mentioned; that the plaintiff, at…
