The plaintiff in error, hereinafter called defendant, was convicted in the district court of Roger Mills county on a charge of rape in the first degree, and sentenced to serve a term of 25 years in the state penitentiary.
The evidence discloses that on the 12th day of August, 1925, defendant, who was 25 years of age, took the prosecutrix, Daisy Lacey, who was 18 years of age, home from a country dance, a distance of about 15 miles.
