Before the Court are defendants Regions Bank’s and Bill Carroll’s Motion for Summary Judgment. For the following reasons, defendants’ motion is DENIED.
I. BACKGROUND
A. The Beechgrove Redevelopment
In August 2002, plaintiff The Conerly Corporation (“Conerly Corp.”) entered into a construction contract with Beechgrove Redevelopment Phase II, LLC (“Beechgrove”) for renovation of certain apartment units in Westwego, Louisiana.
