This is an error proceeding from the court of common pleas of Muskingum county, and the parties stand in this court in an order the reverse of that held in the court below. They will be herein referred to as they stood in the court of first instance.

The petition is grounded on negligence growing out of an automobile collision of the parties’ cars on the 11th day of December, 1928, at a point on the National Pike or Greenwood avenue in the city of Zanesville, Ohio.
