The Delaware corporation of Funch, Edye & Co., Inc., at the time of the service of the summons herein, maintained an office for the transaction of business at 25 Broadway, New York city. The sole question involved upon this appeal is as to whether the corporation served was, at the time of such service, the managing agent of the defendant corporation within the State upon whom personal service of the summons could be made.
