John Stewart, defendant in error, filed his petition in the district court against Falls township, in Chase county, Kansas, to recover for personal injuries sustained on account of a defect in a public highway and culvert forming part of such highway. The action was instituted under chapter 237, Laws of 1887. The petition of the plaintiff below alleges that, while the plaintiff, without any negligence on his part, was driving a wagon over defendant's highway said wagon was upset by reason of defective condition of said highway and the…
