Horton, C. J.:
The plaintiff, passing along the south side of Commercial street, near Sixth street, in Atchison, was injured by a bill or show-board, which, having been placed on a lot adjoining the south side of the sidewalk, had been blown down by- a strong wind and fell upon him. Upon the trial, a demurrer to plaintiff’s evidence was sustained, the jury dis*322charged, and judgment rendered for the defendant. A motion for a new trial was made by the plaintiff, and overruled.
