MEMORANDUM AND ORDER

DAVID S. NELSON, District Judge.

This matter comes before the Court on cross-motions by the plaintiff Mobil Oil Corporation and the defendant Arthur Va-chon for declaratory and preliminary in-junctive relief. Jurisdiction is predicated upon the Petroleum Marketing Practices Act, 15 U.S.C. § 2801 et seq. (hereinafter PMPA) and 28 U.S.C. §§ 1331, 1332, 1337, 2201 and 2202. A hearing on the cross-motions was held on May 18, 1983.
