MANION, Circuit Judge.

The EPA civilly charged Robert Krilich with illegally filling a wetland on property he was developing in suburban Chicago, Illinois. Krilich entered into a consent decree with the EPA to settle the dispute, the terms of which required him, among other things, to create a substitute wetland by a specific date, or pay a substantial penalty for any delay. He failed to complete the new wetland by the stated time, so the EPA moved to enforce the terms of the consent decree. The district court granted that motion and fined Krilich in excess of $1.2 million. Krilich appealed…
