This is an original proceeding in this court instituted by the respondent and its insurance carrier before the State Industrial Commission to procure a review of an award in favor of the claimant therein. Hereinafter the respondent will be referred to as petitioner.
This cause was before this court in Southland Cotton Oil Co. v. Pritchett, 157 Okla. 264, 11 P. (2d) 486. It was therein contended by the petitioner, as it is herein contended by it, that the evidence, as a matter of law, showed that the claimant was an independent contractor and not an employee of the petitioner.
