In an action to recover a commission on the sale of an oil and gas lease, the plaintiff recovered a judgment and defendant is here complaining of rulings made in the course of the trial.

The plaintiff, who was a broker, was employed by the defendant to procure a purchaser for an oil and gas lease on certain land in Oklahoma. It was agreed that for this service he was to be paid the amount received for the property in excess of $11,000.
