Plaintiff filed a writ of summons on January 11,2000 and an amended writ of summons on January 12, 2000. On February 28, 2000, counsel for defendants E.R. Stuebner Inc. and U.S. Fidelity & Guaranty Co., n/k/a St. Paul Fire & Marine1 filed a praecipe to issue a rule upon plaintiff to file a complaint against all three defendants.
