The question in this case is whether hearsay statements made by a nontestifying codefendant manifest sufficient indicia of reliability to be introduced into evidence without violating the defendant's Sixth Amendment right to confront witnesses. The State, as petitioner, contends that the hearsay at issue is admissible because it falls within the hearsay exception for statements against penal interest, ER 804(b)(3).
