This case comes to this Court by the grant of the writ of certiorari. In this opinion Joe W. Lovell, Executor of the Estate of Hall Lovell, will be referred to as plaintiff, and the other parties as defendants, or by name.

This case arose as a result of a vehicle accident involving a pickup truck driven by the defendant Jesse Lee McCullough, with the plaintiff’s decedent as a passenger, and a car driven by the defendant, Biehard Stephen Forester.
