William Ede was tried and convicted of the crime of larceny of a cow, the property of one Ellis S. Dement, and was sentenced to imprisonment in the Oregon state penitentiary for the term of four years. From this judgment and sentence, he has appealed., At the opening of the trial, defendant’s counsel moved the court that all witnesses for the state not at the time under examination be excluded from the courtroom.
