On June 29, 1937, the petitioner Thomas F. Doherty was a captain in the fire department of the city of New York. While off duty on that date he met with an accident resulting in a fracture of the left thigh bone. Following a physical examination, the medical board of the fire department reported to the fire commissioner, respondent herein, that petitioner was permanently physically disqualified for the performance of his duties.
