INTRODUCTION
The matter before us is an application for attorney fees and expenses pursuant to the Equal Access to Justice Act (“EAJA”) recorded at 28 U.S.C. § 2412.1 Plaintiff herein alleges that as the prevailing party in the underlying cause of action, an informant’s award claim under 19 U.S.C. § 1619,2 he is *338now entitled to an award of the attending attorney fees and expenses.
