Where, to a proceeding brought by an assignee on October 11, 1955, to foreclose a conditional-sale contract covering a described automobile for the failure of the purchaser, a resident of Georgia, to make his first monthly payment on September 24, 1955, in accordance with the terms of the contract, which required payment to be made “in such coin or currency of the United States of America as at the time of payment shall be legal tender for the payment of public and *27private debts” at the assignee’s office in South Bend, Indiana, the defendant in fi. fa. interposes his affidavit of illegality…
