This action was commenced by appellee against the appellant to recover damages for the death of her husband, August Dibka, hereafter referred to as the decedent, who was found dead at the foot of one of appellant’s poles in a street in Michigan City on the morning of November 21,1907.

The complaint is in one paragraph, the sufficiency of which is not questioned in this court. It contains averments showing that at the time decedent was killed, the appellant was a corporation operating an electric plant in Michigan City, furnishing light to said city and its citizens; that in the operation of…
