OPINION

LATCHUM, Chief Judge.

E. I. DuPont de Nemours and Company (“DuPont”) filed this action against the Federal Trade Commission (“FTC”) and its individual Commissioners, on October 1, 1979, in an effort to obtain a declaratory judgment that a pending FTC administrative complaint does not allege a violation of the Federal Trade Commission Act 1 (“Act”); and that the FTC violated DuPont’s First Amendment right of free speech by filing the administrative complaint.
