MEMORANDUM

LOWELL A. REED, Jr., District Judge.

This is an action brought pursuant to Title XIX of the Social Security Act, 42 U.S.C. §§ 1396 — 13961, and the regulations promulgated thereunder, commonly known as the Medicaid Program. Plaintiffs allege inter alia that defendant, owner and operator of the Rosemont Manor Nursing Home where Mrs. Arlene Chalfin was a patient from November to December 1986, violated the Social Security Act by discharging Mrs. Chalfin against her will and without the proper justification. 1 Jurisdiction is founded upon diversity, 28 U.S.C. § 1332. 2
