This action is brought to enjoin implementation or construction of a stream channelization project of the Soil Conservation Service of the U. S. Department of Agriculture (“SCS”) on Blue-Eye Creek, a tributary of the Coosa River, in Talladega County, Alabama. The case is before the Court upon reconsideration of the cross motions for summary judgment filed by plaintiff and by the defendant SCS officials.
