On a rule to show cause why a mandamus should not. issue to the judge of the first judicial district, commanding him to *575allow a suspensive appeal, the judge made the following return :

“ The undersigned now comes into the Supreme Court, and, for answer to this rule, respectfully shows: that it appears from the record of the case of Gray vs. Cochran, that a judgment rendered against the defendant, and condemning him to restore to the plaintiff certain property, was notified to the -defendant on the 6th April, 1839.
