Appeal from Crawford District Court.— Hon. Z. A. Church, Judge. Action at law by plaintiff, as administratrix of the! estate of Patrick Henry, deceased, to recover damages occasioned by the negligence of defendant as alleged, resulting in the death of said Henry. At the close of the evidence for plaintiff there was a directed verdict and judgment for costs in favor of defendant. Plaintiff appeals.—

Patrick Henry was a section hand and track walker in the employ of the defendant company, and stationed at Arion, Crawford county. It was a part of his duties to inspect the track for a distance of about two miles east of the depot at Arion each Sunday morning. Conforming’ thereto, he left his home near the depot at about 7 o’clock on Sunday morning, January 12, 1902, and proceeded east to the end of his walk, and then faced about to return home.
