This is a penal action instituted by the Commonwealth against the Phoenix Hotel Company, a corporation, of Lexington, Kentucky, it being charged in the petition that the defendant in violation of section 1944 Ky. Stat., had in its possession three quail between the first of January and the fifteenth of November, in the year 1912, there being three paragraphs to the petition, and a judgment being prayed in each paragraph for the sum of $25.
