¶ 1 This is an appeal from an order granting declaratory relief on the pleadings. We affirm.

¶ 2 On May 1, 2003, Consolidation Coal Company (Consol) and MTB Incorporated (MTB), trading as Conrhein Coal Company (Conrhein) 1 initiated an action to quiet title by filing a complaint against Dennis A.
