ORDER ON MOTION TO DISMISS

Before the Court is Defendant’s Motion to Dismiss Plaintiffs Complaint (Docket #4). For the reasons that follow, the Court GRANTS in part and DENIES in part Defendant’s Motion.

I. LEGAL STANDARD

A motion to dismiss for failure to state a claim under Federal Rule of Civil Procedure 12(b)(6) tests the “legal sufficiency” of a complaint. Gomes v. Univ. of Me.
