Dolly E. Scofield, plaintiff in error, hereinafter called plaintiff, brought suit against her former husband, William E. Scofield, defendant in error, hereinafter called defendant, on two causes of action. In the first cause she seeks to establish a resulting trust covering certain real estate in the city of Denver, standing in defendant’s name, in his possession, and which she claims defendant agreed to convey to her.
