OPINION AND ORDER

HOLMES, District Judge.

Broderick Collier filed this petition for writ of habeas, corpus pursuant to 28 U.S.C. § 2254. United States Magistrate Judge Henry L. Jones, Jr., entered proposed findings and recommendations in which he proposed that the Court find that the petition is barred by the one-year period of limitations in 28 U.S.C. § 2244(d) and recommended that the petition be dismissed with prejudice.
