Elizabeth Westerfield, the plaintiff in this case, complained that she was the wife of William D. Westerfield, and that she and her said husband were in the possession of, and residing upon, the northwest quarter of section 35, in township 23 north, of range 6 east, in Grant county; that she was the equitable owner of the undivided five-ninths of said tract of land; that the defendant Samuel J.
