MEMORANDUM OPINION

HILTON, District Judge.

This matter comes before the Court on cross motions for summary judgment. Plaintiff Corliss Burandt filed a Complaint in this Court on October 10, 2006, seeking judicial review under the Administrative Procedures Act (“APA”), 5 U.S.C. §§ 701 et seq. (2000), challenging a decision made by Defendant Jon W. Dudas, Director of the United States Patent and Trademark Office (USPTO) and Undersecretary of the Department of Commerce for Intellectual Property, denying Plaintiffs petitions to reinstate United States Patent No. 4,961,-406 (the ’406 patent).
