MEMORANDUM DECISION ON PETITION FOR PAYMENT OF UNCLAIMED FUNDS

MARGARET DEE MCGARITY, Bankruptcy Judge.

This proceeding involves a dispute over unclaimed funds held by the Clerk of Bankruptcy Court after the debtor’s chapter 13 case was dismissed without confirmation of a plan, and the trustee was unable to return the funds to the debtor. This court has jurisdiction under 28 U.S.C. § 1334.
