Plaintiff in error was defendant in the trial court and we will refer to her as defendant; defendant in error, plaintiff in the trial court, we refer to as plaintiff, or Kathy.

Plaintiff, two years of age at the time of the injuries complained of, through her father and next friend, filed her complaint against the defendant, alleging two grounds upon which she seeks recovery.
