This case involves an interlocutory appeal from the trial 'court’s denial of Respondent’s motion to dismiss Petitioner’s petition for condemnation. We affirm.
On October 5, 2000, Appellee, David Pickier, acting on behalf of the Shelby County Board of Education (Board) petitioned the trial court to condemn a twenty-acre tract of unimproved real property for the construction of an elementary school.
