Pending before this court is a motion to dismiss filed by defendant Wells Fargo Bank, N.A. (“Wells Fargo”). 2 (Docket En try # 11). The complaint sets out a breach of contract claim against Wells Fargo and defendant Wachovia Corporation (“Wachovia”) (collectively: “defendants”) and seeks recovery of $88,000 in falsely endorsed checks.
