I. INTRODUCTION

Gregory Hill is suing Delta International Machinery Corp. (“Delta”) and Home Depot U.S.A. Inc. (“Home Depot”) for injuries he sustained while using a power saw manufactured by Delta and sold by Home Depot. The suit was originally filed in New York state court on January 29, 2004 and was removed to federal court on April 12, 2005 on diversity grounds. The original complaint named a third, non-diverse defendant, AD Manufacturing Corp. (“AD Mfg.”), who was Hill’s employer at the time of his injury and who was dismissed from the case by…
