MEMORANDUM OPINION
SIMPSON, District Judge.
This matter is before the court on motion of the defendants, Boeing Capital Corporation, et al (“Boeing”), to dismiss plaintiff Donald Heavrin’s (“Heavrin”), second amended and supplemental complaint pursuant to Fed.R.CivP. 12(b)(6). Defendants allege that Heavrin’s claims against them for fraud, perjury, and outrageous conduct fail as a matter of law.
