OPINION
BOGGS, Circuit Judge.
Plaintiff-appellant, Gail Minger, appeals a district court decision granting the Fed. R.Civ.P. 12(b)(6) motions of defendant-ap-pellees, Joseph Green and David Wilson, to dismiss Minger’s wrongful death diver*796sity action. For the following reasons, we affirm in part and reverse in part.
