Memorandum.

Judgment of conviction unanimously modified upon the law by reversing the conviction of assault in the third degree and, as a matter of discretion in the interest of justice, by dismissing said count of the accusatory instrument; as so modified, affirmed.

The prosecutor’s information, which was read into the record, was legally sufficient to support the charges of sexual abuse in the second degree and sexual abuse in the third degree (see Penal Law §§ 130.55, 130.60 [2]).°We note that the very definition of “sexual contact” includes the requirement that it be…
